Terms of Service

These terms govern access to sennd.it and the sennd.it application at app.sennd.it.

Using sennd.it

sennd.it provides software for creating, sending and managing quotes, invoices and related customer records. By using the service, you agree to use it only for lawful business purposes and in a way that does not interfere with the platform or other users.

You are responsible for keeping your account access details secure and for the activity that happens under your account. If you become aware of unauthorised access, you should contact us promptly.

Subscriptions, renewal and cancellation

sennd.it is free to get started. If you choose a paid plan, we will show you the price, billing cycle and any trial terms before you sign up. Paid plans are billed in advance and renew automatically for the same period until you cancel, so you keep access without interruption.

You can cancel at any time from your account settings. Cancelling stops the next renewal and you keep access until the end of the period you have already paid for. Unless the law requires otherwise, fees already paid are not refunded for the remainder of a period.

Prices may change over time. If we change the price of your plan, we will let you know before the change applies to a renewal so you can decide whether to continue. Fees are in Australian dollars and may include or have GST added as shown at checkout.

This section does not limit your rights under the Australian Consumer Law, including any right to a refund where a consumer guarantee has not been met.

Your content

You retain ownership of the business information, customer details, documents and other content you upload or create in sennd.it. You give us a limited permission to host, process, transmit and display that content as needed to operate, secure and improve the service.

You are responsible for making sure your content is accurate, lawful and that you have the right to use it.

Automated drafting and AI

sennd.it uses automated tools and AI to read the messages, receipts, bills, photos and notes you give it and to draft quotes, invoices, line items and customer messages for you. These drafts are a starting point, not finished work.

You are responsible for reviewing everything before it is sent or relied on, including amounts, totals, customer details, tax treatment and wording. AI can get things wrong, miss details, or misread a figure, so please check each quote, invoice and message yourself.

To the extent the law allows, sennd.it is not liable for errors, omissions or losses that come from acting on AI-generated drafts without reviewing them first. Nothing in this section limits rights you have under the Australian Consumer Law that cannot be excluded.

Messaging your customers

When you send quotes, invoices, follow-ups or alerts to your customers through sennd.it over SMS, WhatsApp or email, you are the sender of those messages. You are responsible for having the right to contact each recipient and for the content of what is sent.

You agree to comply with the laws that apply to business messaging in Australia, including the Spam Act 2003 (Cth) and the Do Not Call Register rules, and to honour requests to stop messaging. You also agree to the terms of the platforms and providers that carry your messages, including WhatsApp and Meta and our SMS provider.

We may pause or limit messaging features if we reasonably believe they are being used to send unsolicited or unlawful messages, or where a platform or provider requires us to. You are responsible for any consequences of sending messages without the right consent.

Connected services

sennd.it connects to other services so you can do more in one place, including accounting tools like Xero and QuickBooks, messaging platforms like WhatsApp, AI providers, and payment and SMS providers. When you connect one of these, you authorise sennd.it to exchange the data needed to make the integration work.

Those services are run by the third parties, not by us, and your use of them is also subject to their own terms and privacy policies. We do not control their availability, accuracy or changes to how they work.

We are not responsible for loss caused by a connected service being unavailable, changing, syncing incorrectly or being discontinued. If an integration stops working, we will try to help where we reasonably can, but you may need to manage some records directly in that service.

Acceptable use

You must not use sennd.it to break the law, send spam, infringe intellectual property rights, attempt to gain unauthorised access, reverse engineer the service, or upload malicious code.

We may suspend or terminate access where we reasonably believe the service is being misused, where continued access creates risk, or where required by law.

Availability

We work to keep sennd.it available and reliable, but we do not guarantee uninterrupted service. Maintenance, updates, outages and third-party failures can affect availability from time to time.

We may add, change or remove features as the product evolves. Where a change materially reduces a core part of the service you rely on, we will give reasonable notice where we can.

Our intellectual property

sennd.it, including the software, design, branding and content we provide, belongs to us or our licensors. While your account is active and in good standing, we give you a limited, non-exclusive, non-transferable licence to use the service for your own business.

You may not copy, resell, sublicense or build a competing product from the service, and you may not remove our branding or notices. This licence ends when your account ends.

Ending your account

You can stop using sennd.it and close your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if your account creates a security or legal risk, or if we stop offering the service, in which case we will give reasonable notice where we can.

Before you leave, you can export your quotes, invoices, contacts and related records from the app. After your account ends we will keep your data for a reasonable period in case you return or to meet legal and accounting obligations, then delete or de-identify it in line with our Privacy Policy.

If you would like help exporting your data or want your data deleted sooner, contact us at hello@sennd.it and we will assist where we reasonably can.

Your responsibility for claims

You agree to cover sennd.it for reasonable losses, costs or claims that come from your use of the service in a way that breaks these terms or the law, from the content you upload, or from messages you send to your customers through sennd.it.

This does not apply to the extent a loss is caused by sennd.it's own breach of these terms or by something we are responsible for at law. We will let you know promptly if a claim like this arises and give you a reasonable chance to help deal with it.

Liability

To the extent permitted by law, sennd.it is provided on an as-is basis and we exclude warranties that are not expressly stated in these terms. We are not liable for indirect, incidental or consequential loss, including lost profits, lost data or business interruption.

Nothing in these terms excludes rights or remedies that cannot be excluded under applicable consumer law.

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms removes or limits those guarantees, and you may be entitled to a remedy if a guarantee is not met.

Where the law allows us to limit our liability for failing to meet a guarantee — for example, where the service is supplied to you for business use — our liability is limited, at our option, to supplying the service again or paying the cost of having it supplied again.

Apart from those guarantees, the limits on our liability set out in these terms apply.

Governing law and disputes

These terms are governed by the laws of Victoria, Australia. You and sennd.it submit to the non-exclusive jurisdiction of the courts of that state and the courts that hear appeals from them.

If a dispute comes up, we ask that you contact us first so we can try to sort it out quickly. Most issues can be resolved this way without anyone needing to go further.

If we cannot resolve it between us, either party is free to pursue the matter through the courts. Nothing here stops you from exercising rights you have under Australian law.

Events outside our control

We are not responsible for delays or failures caused by things outside our reasonable control, such as outages at a hosting, messaging, AI or payment provider, internet or network failures, natural events, or actions of government or platforms we rely on.

If an event like this affects the service, we will do what we reasonably can to limit the impact and restore normal operation.

Feedback

If you share ideas, suggestions or feedback about sennd.it, we may use them to improve the product without any obligation to you and without owing you anything for them. You are not required to give feedback, and anything you do share is given freely.

Changes to these terms

As the product grows we may update these terms. When we make a material change we will post the updated terms here with a new effective date, and where the change significantly affects paid users we will give reasonable notice, for example by email or in the app.

If you keep using sennd.it after a change takes effect, that means you accept the updated terms. If you do not agree with a change, you can stop using the service and close your account.

General

If part of these terms turns out to be unenforceable, the rest of the terms still apply. Our not enforcing a term straight away does not mean we give up the right to enforce it later.

You may not transfer your rights under these terms without our agreement. We may transfer ours, for example if our business is sold or reorganised, as long as your rights are not reduced.

These terms, together with our Privacy Policy and any plan details shown to you, make up the whole agreement between you and sennd.it about your use of the service.

About these terms

sennd.it is operated by William Earl Armstrong (ABN 34 813 782 926). These terms are written in plain language to be easy to read — they are a general template rather than legal advice for your situation, so it is worth having them reviewed for your circumstances.
